lampviews operates a website at www.lampviews.com for the presentation and promotional marketing of its products (hereinafter referred to as “website”). The website is divided into a public area, which every visitor to the website (hereinafter referred to as “user”) can access, and an area (hereinafter referred to as “private user area”) which users can only access after registering. The subject matter of these terms of use consists of (i) the terms and conditions for using the website as a whole and (ii) additional terms and conditions for the private user area.
a. User account: Refers to the area of the website accessible to individual users via their lampviews ID, in which they can, for example, create and save product lists.

b. lampviews ID: lampviews ID refers to the user access data allowing the user to access the private area of the website. This consists of the username specified by the user and a self-determined password.

c. Private user area: Generally refers to the area of the website that users can only access after prior registration, i.e. creating a lampviews ID. Special features are available here, such as creating product lists and accessing information.

d. Product list: The product list can be used to collect information about an individual selection of products on the website for the duration of the visit.

a. By using the website, the user declares his/her agreement with these terms and conditions of use to the extent that they concern the public part of the website; these terms and conditions of use shall also apply when the user uses the website or parts of it from other websites.

b. When registering for a lampviews ID and thereby a user account for the private user area, the user agrees to the terms of use as a whole and in particular for the private user area; consent will be requested from the user and recorded electronically when given.

a. Free of charge principle for services: lampviews does not charge any costs or fees for the use of the website it provides. Free services and benefits are offered exclusively to users as part of the website service.

b. Right of modification reserved for free services: lampviews reserves the right to modify, restrict or supplement the free services at any time with future effect. Section 5.c. also applies to the private user area in the event of modifications to services/benefits. 5.c.

c. Rights to content provided by lampviews: In its relationship with the user, lampviews holds all ownership- and copyright-related rights of use and exploitation for all documents, e.g. product brochures and presentations, plans, photos, drawings, texts, illustrations, computer programs and documentation, data/files (e.g. CAD files), databases/database systems, brands, corporate designs and other protectable content that is provided on the website (hereinafter referred to as “lampviews content”). Any use of lampviews content or parts thereof requires prior express written consent from lampviews if such use goes beyond (i) simply viewing content when the website is called up, (ii) the use of lampviews content that can be downloaded separately for a specific purpose and (iii) the free forwarding of lampviews content that can be downloaded separately for a specific purpose to a specialist dealer when the user is an end customer and, for the event that the user is a dealer or specialist dealer, the free forwarding of lampviews content that can be downloaded separately for a specific purpose to end customers.

Where appropriate, the user’s approval for separate terms and conditions of use or those that differ from the above arrangements will be requested and recorded when given; in this case, the content cannot be downloaded without prior approval being given for the special terms and conditions of use.

If the lampviews content is a software, its use permitted without special approval from lampviews is limited subject to a special, deviating agreement to the running of the downloaded software for a specific purpose on a data carrier and to its forwarding to end customers and its running by them for a specific purpose if the user is a dealer or specialist dealer. This includes any duplications and backups that are technically required in each case for the above-mentioned purposes.

d. lampviews software/Minimum requirements/Installation instructions:

If you make use of the free software download function, please ensure that you refer to the installation instructions relating to the software which are provided on the website. These installation instructions also specify the minimum technical requirements for using the respective software.

e. No guarantee of website availability: The website provided by lampviews is available to the user solely based on the technical possibilities existing at lampviews and is therefore not available permanently or, if applicable, without interruption. Downtimes are possible in particular due to maintenance work. Downtimes due to technical problems or problems of another nature that are beyond lampviews’s control, e.g. force majeure or third-party negligence, cannot be ruled out and are not the responsibility of lampviews.

f. Responsibility according to Law: As a supplier, lampviews is responsible according to general legislation for its own content that is provided for use. A distinction must be drawn between such own content and links to the content provided by other suppliers. lampviews does not check the content of these third-party links. However, if lampviews discovers or learns from third parties that the content of the third-party website or document to which lampviews has created a link contains unlawful data, lampviews will delete its reference to this service immediately.

g. Commitment by the user to observe statutory provisions and to use the website for its intended purpose: The user is responsible for observing statutory provisions when visiting the website. When using the website, the user is not permitted in particular (i) to violate the rules of common decency, (ii) to infringe industrial property rights, copyrights, or other ownership rights, (iii) to forward content with viruses, so-called Trojans or other programs that can damage software or the website (hereinafter referred to as “malware”), or (iv) to circulate advertising or unsolicited e-mails (spam) or inaccurate warnings of viruses, malfunctions and the like, or to solicit participation in competitions, snowball systems and similar activities. Furthermore, the user must refrain from all activities that could (i) overload the website or impair or manipulate the functionality of the website infrastructure in any other way or (ii) endanger the integrity, stability or availability of the website.

h. Limitation of warranty and liability for content provided free of charge: Although the content of the website is created with the greatest of care, lampviews does not guarantee the availability or quality of information provided free of charge, nor that such information is up to date, correct, complete, or free from third-party property rights and copyrights. Except for claims involving personal injuries, no liability claims made against the lampviews will be accepted if they arise from the use of inaccurate and/or incomplete information, unless lampviews acted with intent or gross negligence. The same applies for the absence of malware from the downloadable content.

i. No binding nature of product information: The information offered on the website may include specifications or general descriptions of the technical options for products, including their technical dimensions, that may not be available all cases (e.g. due to product modifications). For this reason, the required product performance characteristics and other product features that might be necessary for the planning and implementation of lighting projects will only be stipulated upon purchase.

j. Further limitations to liability for the use of the website: lampviews excludes any liability for damages caused by negligence. Strict liability is also excluded for lampviews with respect to tenancy and lease legislation and similar relationships of use for errors already existing upon signing the contract.

k. Data protection: Matters relating to data protection are governed by the separate privacy policy.

l. Right of modification for the terms and conditions of use: lampviews is authorised to modify and/or supplement these terms and conditions of use at any time with future effect. The most recent version of the terms of use is available online at Section 3.c and/or 4.h also applies 5.c.

m. Applicable law: The use of the website and the legal relationship between the user and lampviews are subject to international law.

a. Registration, commencement of the contract of use

i. Access to the private user area requires prior registration of an account and the associated assignment of a lampviews ID. There is no entitlement to registration for using the user area. Registration as a user and technical maintenance of the user account are provided free of charge.

ii. The information provided in the registration must be accurate. The data collected during the registration and particularly the mandatory data must be kept correct at all times and be updated by the user as required if any changes occur.

iii. If the registration mask is completed and despatched correctly, lampviews will confirm the registration by e-mail. In this e-mail, the user will be asked to verify their registration, and therefore the creation of a lampviews ID and associated user account, by clicking a link. Verification by lampviews is accompanied by an offer to conclude a user contract. The user contract comes into effect between the user and lampviews when the user logs into their user account for the first time using their lampviews ID. Any lampviews ID that is not verified in this way may be deleted without possibility of replacement ten (10) calendar days after the attempted registration. It is not possible to repeat the registration.

iv. lampviews is prepared to complete a contract of use solely with persons of full age who have unrestricted legal capacity. The registration of a legal person is allowed to be undertaken only by an authorised natural person whose name must be entered.

v. The user must undertake to keep their user account access data secret, and to protect this data from discovery by third parties. This access data is the user’s individual lampviews ID. lampviews must be notified if there are signs that the access data are known to unauthorised persons. The user shall be liable for all actions carried out using their user account and/or access data. This does not apply if the user is not responsible for the misuse of the user account and/or lampviews ID.

vi. Multiple registration of one and the same natural person is not permitted.

vii. User accounts or individual claims against lampviews arising from the user contract may not be transferred or assigned.

viii. The user is not entitled to make any claims against lampviews if the saving of his product lists and similar compilations of products and/or product information fails the first time or repeatedly. If transmitted or online documents (e.g. as part of a document archive) are needed permanently for a user’s own purposes, the user must save them in his own system or print them out and keep them safe.

b. Change to product features: The user’s attention is drawn to the fact that technical characteristics and the availability of products can change at any time within the scope of applicable law. In this case, the content of files presenting such products (e.g. CAD files) will also change accordingly. For example, if the user creates watch lists and other collections of information in order to carry out lighting design projects, the user should check the corresponding features and availability of lampviews products used before implementing each planning stage, and certainly before sending the planning documents to third parties, such as end customers.

lampviews is not responsible for any consequences that arise if the user is not working with the latest information or files.

c. Changing the terms and conditions of use for the user area

i. lampviews reserves the right to modify or amend the terms of use for the private user area at any time with future effect. lampviews will indicate this to the user by displaying the changed terms and conditions in the user account in text form, at least by showing these new terms and conditions of use to the user the first time they log into the user account after the change has been made. If required, the changes will also be announced to the user in a separate email. The user will have the opportunity to confirm their acceptance of the changed and/or amended terms of use.

ii. If the user rejects the changed terms and conditions of use, the new terms and conditions will not become part of the contract of use. lampviews is then authorised to terminate the user contract for good cause and delete the user account.

d. Effective term, termination, deletion, blocking and ending of the contract of use

i. The contract of use is established indefinitely. It can be ended at any time by either the user or lampviews. The user can terminate the user contract by deleting their user account, which will result in the loss of the lampviews ID. lampviews can end the contract of use at any time by giving four weeks’ notice.

ii. lampviews is entitled but not obligated to delete a user account that has not been used for more than one year by the user at least logging in. lampviews will notify the user about an imminent deletion at least four weeks in advance by email, or remind the user about the existence of the unused user account. The user hereby agrees that the user contract will be terminated in the event that the user account is not used for more than one year.

iii. If the user account is deleted by the user in accordance with 5.d.i., sentence 2 or if termination by lampviews becomes effective, all of the user’s data will be irrevocably and completely deleted from the lampviews database. The user will be informed about these consequences by receiving the termination notice from lampviews.

iv. If an objective reason exists, and as long as the objective reason exists or until it is eliminated, lampviews is authorised to block a user’s right of access to the user area at any time by deactivating the account. Data will be preserved when access is blocked. An objective reason exists in particular if (i) the user has registered with incorrect information, (ii) the user fails to comply with these terms and conditions of use or his obligations to exercise due diligence when handling the access data, or (iii) the user violates the applicable law when accessing or using the website.

v. No services can be received or accessed, and no data stored in the user account can be accessed while the account is deactivated or after it is deleted.

vi. The contract of use can be terminated for cause without notice by either party. Good cause can be in particular a serious infringement of the contract by the user, e.g. violations of statutory regulations or a serious violation of Section 5 of these terms and conditions of use.

vii. After the user contract has ended and/or after the user account is deleted, the user may, in principle, register again.

Privacy policy

a. On its website, lampviews offers a public area and a private (access-protected) area (“user area”), which pose different usage requirements (see the terms and conditions of use). Accordingly there are also differences in the processing of personal data.

b. When the public area of the website is used, the user’s automatically anonymised IP address is saved. As a result of the anonymisation, it is impossible to identify the anonymised user and tracking their movement on the website does not allow for any conclusions to be drawn about a specific user.

c. The user is required to register or log in with an existing lampviews ID in order to use the access-protected user area.

a. Visiting the website/free downloads

With every website visit and download of documents in the freely accessible area of the website, the respective user’s log files as listed below are recorded automatically:

Information about the browser type and version used

-The address of the preceding website visited
-The user’s anonymised IP address
-Every successful log-in to the user’s account
-Date and time of access
-The e-mail address.

In addition, the following log files are recorded within the context of use of the access-protected area:

-Change of password by user
-Error during registration
-Change of user data
-Error during deletion process for user
-Error when re-sending the activation e-mail
-(Un)successful activation
-Error when sending the “forgotten password” e-mail
-Data protection or terms and conditions of use were accepted by user

b. lampviews ID

lampviews processes the following data for receipt of the lampviews ID:

-Title
-First name
-Surname
-Branch
-Company
-Address
-House number
-Post code
-Town
-Country
-Phone number
-Fax number
-Mobile phone number
-Website

c. Contact by e-mail

If the user opts to contact lampviews by sending an e-mail, the e-mail address, all data technically associated with the e-mail and the contents of the e-mail will be saved. In particular, the e-mail address, if personalised, may be a piece of personal data, as may the e-mail contents or parts thereof.

d. Use of the contact form

lampviews processes the data supplied by the user via the contact form:

e. Application documents

Application documents may also be submitted by e-mail. Data which are processed within this context are personal data.

a. Visiting the website/free downloads

The log files are processed in order to ensure the functionality of the website. The data are also used in order to optimise the website and ensure the security of the information technology systems. No analysis of the data is performed for marketing purposes.

b. lampviews ID

The data entered by the user upon registration to receive the lampviews ID are used solely for the purpose of performing the functions offered as part of lampviews’s telemedia and for carrying out the contract of use. As such, the data are used solely for internal customer administration purposes and for processing enquiries from the registered user.

If users log in to their user account using their lampviews ID, they can create what are known as project lists. These are then saved in a lampviews database and can be accessed as long as the user account exists.

c. Making contact

The data entered by the user when making contact are used solely for the purpose of processing the user’s request.

d. Application documents

The data are processed in order to determine the applicant’s qualifications and suitability for the lampviews vacancy to be filled.

Alongside lampviews, recipients of the data may be third parties which process data on lampviews’s behalf or which have access to the data as part of their service provision to lampviews (e.g. IT service providers). There is a data processing agreement with these third parties.

When lampviews is contracted by users to provide services or to supply products, it is necessary under certain circumstances to forward personal data such as name and address to companies which lampviews uses to provide a service or deliver a product. No other transfer of user data to third parties will take place unless the user gives express consent.

The user has the option of downloading project lists within the user account (cf. terms and conditions of use). In this case, the user has the option to choose whether a sales partner pre-selected by lampviews and responsible for the site where the project is being conducted will receive the project list data and the user’s contact data (opt-in). Such an arrangement is not made without the user’s active choice.

All data are saved on servers or computers; they are not transferred to a third country, nor are there any plans to do so.

The forwarding of personal data to governmental institutions and authorities takes place only within the scope of statutory regulations.

a. Session ID cookies

Public area:

In the public area of the website, the user can create what is known as a watch list. lampviews uses so-called session ID cookies to save this list. Cookies are small text files which save the settings of websites, e.g. in the user’s web browser, in the course of using the website. The cookies are used to save user-related information and, amongst other things, enable the user to create watch lists (cf. terms and conditions of use). The session ID cookies used by lampviews are saved solely for the current session in the user’s web browser and are deleted automatically when the browser is closed.

Access-protected area

lampviews also uses session ID cookies within the access-protected area. As soon as the user has logged in to the access-protected area, the session ID cookies save the link to the website that was open at the time of the log-in, the language selected at the time of the log-in and the information about whether the privacy policy is to be displayed to the user. In addition, the remote user ID and user ID are recorded. The session ID cookies used by lampviews are saved solely for the current session in the user’s web browser and are deleted automatically when the browser is closed.

Use of the access-protected user area requires the user to allow the session ID cookies used by lampviews and to permit the saving of data by sessionStorage.

b. Matomo

The Matomo open-source analytics tool, which saves a cookie on the user’s hard disk for seven days, is used for the processing of statistical data concerning the use of this website (public and access-protected area), e.g. how often which products are placed on watch lists. No personal data are collected when the statistical data are transferred. All data processed by Matomo are stored on the lampviews servers. The user’s IP address is truncated before it is stored in order to prevent any conclusions being drawn about the natural person. lampviews uses Matomo to analyse usage behaviour solely for internal purposes and to improve its range of products and services. This involves recording the user’s complete navigation path on the website, therefore including details about which sections/products are accessed during use of the website, scrolling behaviour, the playing of videos, time, operating system, duration of use, links, exit and anonymised IP address.

In the case of users who have activated a “Do not track” function in their browser, no web tracking is performed with Matomo. Moreover, it is possible to opt out of the anonymous usage data analysis by Matomo via the opt-out page: Activate or deactivate data collection by Matomo..

a. YouTube

lampviews operates a video channel on the YouTube website, which can be accessed from www.lampviews.com via a link. The YouTube website operator is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (hereinafter “YouTube”).

When the user clicks on the link, a connection is established to the YouTube servers. As part of this process, information is passed on to the YouTube server about which pages of the www.lampviews.com website the user has visited.

b. Facebook

Links are also used which take the user to the Facebook social network, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (hereinafter “Facebook”).

When the user clicks on the Facebook link on www.lampviews.com, the user is taken to the lampviews Facebook profile and information is passed on to the Facebook server about which lampviews web pages the user has visited. If, at this point in time, the user is logged in as a Facebook member, Facebook will associate this information with the user’s personal Facebook account.

If plug-in functions are used (e.g. clicking on the “Like” button, leaving a comment), this information is also associated with the Facebook account.

c. LinkedIn

lampviews operates a Company Page on the LinkedIn network. The supplier is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA (hereinafter “LinkedIn”). If the user clicks on the LinkedIn link on www.lampviews.com, the user is taken to the Company Page maintained by lampviews.

If the user clicks on the LinkedIn “Recommend” button and is simultaneously logged in to his or her LinkedIn account, it is possible for LinkedIn to associate the visit to the lampviews website with the user’s account. Please note that lampviews, as the supplier of the pages, has no knowledge about the content of the transferred data or usage of these data by LinkedIn.

g. Instagram

The data will be stored until they are no longer necessary in relation to the purposes for which they were collected or until consent that was given is withdrawn.

This applies as follows:

-Log files: are deleted automatically every 14 days

-Download: on completion of the download

-Transmission of contact form / e-mail: The data are deleted one year after the enquiry has been answered unless there has been further communication on the same topic before this deadline has passed or the data are still required due to a contractual relationship (for the purpose of executing/implementing the contract) or need to be kept for periods defined by law due to statutory storage obligations.

-Registration details: once the usage relationship has come to an end

-Application documents: The data are deleted one year after a rejection has been sent. The documents of any applicant appointed by lampviews are transferred to a personal file.

-Cookies/analytics tools: see above

The user has the right at all times, subject to the legal requirements being satisfied, to information about the personal data concerning him or her that we have stored, as well as the right to rectification , the right to restriction of processing and the right to erasure of personal data concerning him or her .

If the user has exercised his or her right to rectification, erasure or restriction of processing with lampviews, lampviews will communicate this rectification or erasure of the data or restriction of processing to all recipients to whom the personal data in question were disclosed, unless this proves impossible or involves a disproportionate amount of work.

The user also has the right, in respect of consent given, to withdraw this consent. The proper withdrawal of consent does not affect the lawfulness of the collection of data prior to this withdrawal.

In addition, the user has the right, for reasons arising from his or her particular situation, to object at any time to the processing of the personal data concerning him or her.

The user also has the right, subject to the legal conditions being satisfied, to receive the personal data concerning him or her that he or she has provided to lampviews in a structured, commonly used and machine-readable format.

In order to exercise these rights, the user should use the contact details in section 1 or 2.

The user further has the right, subject to the legal conditions being satisfied, to lodge a complaint with a supervisory authority.

For the reasons listed in the terms and conditions of use, lampviews is entitled to block a user’s right of access to the access-protected area by the deactivation or complete deletion of the user account by an administrator. In the case of blocking, the previously collected data will not be deleted automatically. The user’s right to request the deletion of his or her data is not affected by this. lampviews reserves the right to place the e-mail address of the blocked user on a so-called blacklist, preventing him from re-registering with this e-mail address.
